Asheville dental patient with broken jaw loses appeal to NC's second highest court
In front of the second-highest court in the state, a dental patient from Asheville lost her lawsuit for medical malpractice involving a broken jaw.
Rashunda Harrison, a former resident of Asheville, lost a 3-0 decision by the North Carolina Appeals Court on March 1 because, according to the court, she waited too long to file her complaint against Dr. Richard Morris of Fox Dental Associates in Asheville and the three-year statute of limitations had already run.
Judge Fred Gore, writing on behalf of the court, also stated that Buncombe Superior Court Judge Marvin Pope's decision to overturn Buncombe Superior Court Judge Alan Thornburg's order extending the statute of limitations was not incorrect.
